SC stays appointment of 2 MLCs under Guv quota

The appointment of Prof. M. Kodandaram and Amer Ali Khan as MLCs under the Governor’s quota by the Congress government in Telangana has become more complex, with the Supreme Court on Wednesday granting a stay on the state high court’s order that had quashed these appointments.

A bench of the Supreme Court, consisting of Justice Vikram Nath and Justice P. B. Varale, issued a notice to the Telangana government and the Governor in response to a petition challenging the Governor's refusal to nominate Bharat Rashtra Samithi (BRS) leaders Dr. Dasoju Sravan and Kurra Satyanarayana as MLCs.

The bench has sought responses from the Telangana government, the Governor's Secretary, and other relevant parties regarding this petition.

Earlier this year, in March, the Telangana high court had annulled the Governor's orders rejecting the nominations made by the State Council of Ministers in 2023. However, the court did not issue any positive direction to the Governor for the appointment of Sravan and Satyanarayana as MLCs.

The high court also annulled the Congress government's recommendations made in January for the appointment of M. Kodandaram and Amer Ali Khan as MLCs.

Sravan and Satyanarayana challenged the high court’s decision not to direct the Governor to appoint them before the Supreme Court.

The Supreme Court bench noted that any appointments made would be subject to the outcome of this petition.

Senior Advocate Kapil Sibal, representing the petitioners, argued that they were entitled to a mandamus against the Governor's refusal to appoint them to the Legislative Council.
