Tata Consultancy Services (TCS), India's largest IT outsourcing firm, is facing allegations of visa fraud.
Whistleblowers claim TCS misused L-1A manager visas to bring workers to the US, misclassifying them as managers to bypass labor laws.
These allegations are based on lawsuits and a Bloomberg News investigation, though their authenticity remains unverified.
The accusations stem from a 2017 incident where Anil Kini, a former TCS manager, was allegedly instructed to falsify organizational charts to misrepresent frontline employees as managers for visa purposes.
Kini, along with two other former employees, has filed lawsuits accusing TCS of exploiting the L-1A visa system, which has fewer regulations than the H-1B visa.
Despite the dismissal of Kini's lawsuit earlier this year, he has appealed the decision.
Between 2019 and 2023, TCS received over 6,500 L-1A visas, more than any other company. However, the company reported far fewer managers in the US, raising concerns about potential misuse of the visa system.
TCS denies any wrongdoing, insisting it follows all US laws.
