CM Can't Move SC Against Bifurcation

Deputy Chief Minister C Damodar Rajanarsimha on Monday lashed out at Chief Minister N Kiran Kumar Reddy for contemplating moving Supreme Court against bifurcation of the State.

In a letter addressed to Chief Secretary PK Mohanty, the Deputy CM said Kiran cannot move any court without an approval of the Cabinet.

If such is the case, the government will have no responsibility as Telangana leaders are in favor of bifurcation. He warned that any kind of help from the government in this regard would be unconstitutional and unlawful.

He asked the Chief Secretary to refrain from filing a case in the apex court which will lead to a Center-State dispute.

The State Government can do so if the council of ministers intends to do it, he said.

Since going against the Centre’s decision on according statehood to Telangana is itself an unlawful and illegal act, no help from the government side should be made to move the court.

“Bifurcation of the State is a prerogative and preserve of the Centre and it cannot be questioned by the State government. The Centre can divide any State through Article 3 and Assembly or the state government will have no role to play in it,” he clarified.
