Can Kiran Go to Court Over Bifurcation?

Couple of days before the Parliament session is about to begin, a serious debate is on as to whether Chief Minister Kiran Kumar Reddy can file a petition in Supreme Court against unjust bifurcation.

The T Bill has been rejected by a symbolic voice vote in the state Assembly and this has left many Telangana leaders fuming.

During the time, some members from the Congress party had given notices to the Speaker protesting against the resolution moved by the CM.

Given this background, if the CM chooses to approach the Supreme Court, he will have to get the state Cabinet’s approval.

In case he chooses to go to Court directly through the Chief Secretary, then the Telangana ministers are bound to file counter petitions. This will make a huge dent to the Party’s image all across the country. Also, it is not clear as to what extent the Supreme Court can intervene without Cabinet’s approval.

However, if Kiran Kumar Reddy manages to get individuals to file a petition in Supreme Court, then the situation will be totally different.

So, it is highly unlikely that the CM can file a petition against bifurcation in his official capacity.
