Why FIR in a case dismissed by SC, asks Sunil

Senior IPS officer and former Andhra CID chief PV Sunil Kumar said there was absolutely no case against him in connection with the alleged torture of Telugu Desam Party legislator K Raghu Rama Krishnam Raju in the police custody in connection with a case against him in 2021, when the latter was a rebel YSR Congress party MP.

Sunil Kumar took to Twitter on the charges filed by TDP government on him.

He said: "I leave it to your wisdom to understand how an FIR can be filed anew in a case that has already been dismissed by the Supreme Court after three years of proceedings".

What exactly is the Raghu Ramakrishnam Raju case?

In May 2021, the CID filed a case against Raju, who was then an MP representing the ruling party, YSRCP, and arrested him for allegedly making inflammatory and violence-inciting statements while being an MP. 

The CID alleged that when he was arrested in Hyderabad, he attacked the police. His bail petition was rejected by the High Court. 

According to a clarification issued by the YSRCP, Raju alleged that he was assaulted in custody when he was presented before the Magistrate Court, hoping to obtain bail. Additionally, he filed a petition in the AP High Court claiming custodial violence. 

The High Court ordered a board of doctors to conduct all tests and report whether he was tortured in custody. Dr. Prabhavathi, the in-charge of the Guntur Hospital, was directed to provide this report. Four doctors conducted all the tests, including X-rays and scans, and reported no injuries to the court.

“Dr Prabhavathi alone did not give a report. It's unlikely that four doctors would provide a false report. The High Court accepted this medical report. If it were otherwise, they would have ordered another medical test. Therefore, Raghurama Raju did not get bail and was transferred to the district jail,” the YSRCP said.

The CID claimed that once Raju was transferred to the district jail, its responsibility ended. Doctors reported that the CID did not torture him.

“Once someone leaves CID custody, whatever happens afterward is not the CID's responsibility; this is common sense. Any subsequent hospital report pertains to incidents after leaving CID custody,” the CID said.

After spending one day in district jail, Raju was released by Supreme Court order and went to Hyderabad Army Hospital in his vehicle. Tests were conducted there two days later, and this report also did not indicate any injuries from being beaten. 

Based on this report, Raju requested a CBI investigation from the Supreme Court, which was denied, stating there wasn't enough matter in the military hospital report to warrant a CBI investigation.

“Now, for political reasons, Raghurama wants to use the case rejected by the Supreme Court for his vendetta. Will the new government fall into his trap and conduct an investigation rejected by the Supreme Court to fulfill his vendetta?” the YSRCP asked.
