Transfer of Andhra judge, a big relief for Jagan!

The recommendation made by a collegium of Supreme Court for transfer of senior judge of Andhra Pradesh high court Justice Cheekati Manavendranath Roy is considered to be a big relief for YSR Congress party president and chief minister Y S Jagan Mohan Reddy.

The Supreme Court Collegium passed a resolution to this effect on Thursday and made recommendations to the Centre to that effect.

While Justice Roy has been recommended for transfer to Gujarat high court, another Andhra Pradesh high court judge Duppala Venkata Ramana has been proposed to be moved to Madhya Pradesh high court.

Justice Manavendranath Roy delivered several judgements that went against the Jagan Mohan Reddy in the last couple of years.

The latest judgement given by him was on stalling the Jagan government’s proposal to construct houses for weaker sections in R-5 zone of Amaravati. Justice Roy made some sharp comments against the Jagan government.

It was the same judge who stalled the sedition case filed by the CID against rebel YSR Congress party MP from Narsapuram Kanumuru Raghu Ramakrishna Raju and a couple of media channels.

And one of the other major judgements delivered by Justice Roy against the Jagan government was to dismiss the CID case of insider trading in Amaravati against former chief minister N Chandrababu Naidu.

The judge observed that the prosecution's case carries little weight and is plagued by legal infirmities, and noted that prosecution under criminal law cannot happen on "flimsy grounds".

Justice Roy found fault with the Jagan government for criminalising private sale transactions and attributing criminal liability to the buyers of the lands to prosecute them under criminal law.

The same judge also delivered a judgement quashing the cases filed by the Jagan government against former advocate general Dammalapati Srinivas and daughters of former Chief Justice of India N V Ramana in the Amaravati land issue.

Interestingly, Justice Roy himself sought transfer from Amaravati high court to Telangana high court. But the collegium rejected his plea and proposed to shift him to the Gujarat high court.

Similarly, Justice Ramana also sought reconsideration of his proposed transfer or to be transferred to the Karnataka high court, but he is being shifted to Madhya Pradesh.
