Case against Ayyanna can go on, but no arrest

The Andhra Pradesh high court on Wednesday gave clearance for the state crime investigation department (CID) police to go ahead with the case against senior Telugu Desam Party leader and former minister Ch Ayyanna Patrudu in the forged documents case.

However, the high court said the CID should follow the due procedure by serving notices on Ayyanna Patrudu under Section 41-A of the Criminal Procedure Code for questioning him.

The court declared that Section 467 of the Indian Penal Code under which the accused could be imprisoned for more than 10 years, would not be applicable to Ayyanna.

The court, however, refused to quash the case against Ayyanna, but ordered that no undue harassment of the accused be done in the case.

Counsel for the TDP leader V V Satish, the counsel for the petitioners, said the alleged NOC which is said to be fabricated or forged does not confer any valuable security to the petitioners.

The NOC is for construction of house in the property which belongs to the petitioners, he said, adding that when there is no additional benefit to the petitioners by way of NOC, section 467 cannot be applied to the case.

The high court agreed with the contention of Satish and granted relief to Ayyanna to that effect.
